Work Visa(subclass 186-Permanent)

Employer Nomination Scheme (ENS) visa (subclass 186)

The Subclass 186 (ENS) visa enables Australian employers to recruit highly skilled individuals on a permanent basis. Such individuals might be overseas or they may be temporary residents currently in Australia. Workers can be appointed to vacancies employers have been unable to fill through the local labour market. The Subclass 186 (ENS) visa is available to all Australian employers who meet the relevant requirements. Positions need to be available for 2 years. Holders of the Subclass 186 (ENS) visa and their family members are allowed to live, study and work permanently in Australia and benefit from Medicare and some other social security benefits.

The ENS visa has three streams:

  • Temporary Residence Transition (TRT)
  • Direct Entry (DE)
  • Labour Agreement stream.

Temporary Residence Transition (TRT)

The TRT stream is for Temporary Skill Shortage (TSS) visa (subclass 482) visa holders or the Temporary Skilled (Work) visa (subclass 457) visa holders who have worked in the position for their employer for at least the last three years out of four years before being nominated and the employer wants to offer them a permanent position in that same occupation.

  •  for subclass 457 visa holders who have worked for their employer for at least the last 2 years and the employer wants to offer them a permanent position in that same occupation.
  • for Temporary Skill Shortage (subclass 482) (TSS) visa holders who have worked for their employer for at least the last 3 years and the employer wants to offer them a permanent position in that same occupation.

You must,

  • Less than 45 years of age
  • competent English unless exempted
  • Applicant is 482 visa holder (or previous 457 visa holder) in the nominated occupation

Direct Entry (DE)

The DE stream provides employers with the opportunity to employ overseas workers who are untested in the Australian labour market. This stream also accommodates workers within Australia who are ineligible for the TRT stream. For the nominated occupation to be eligible, it must be on the relevant occupation list at the time of nomination application.

You must,

  • Less than 45 years of age
  • comptant English unless exempted
  • An assessing authority has assessed the applicant’s skills as suitable for the occupation.

Labour Agreement stream

The Labour Agreement stream is for persons who are being sponsored by an employer who is a party to a labour agreement that is in effect.

  • Applicants for ENS visa may be in or outside Australia but not in immigration clearance. Applicants in Australia must hold a substantive visa or a Bridging visa A (BVA), Bridging visa B (BVB) or Bridging Visa C (BVC).
